Terms of service

Last updated 28 July 2026. Please read these terms carefully before using Gallerite.

1. Acceptance of terms

Gallerite is operated by Gallerite Ltd ("Gallerite", "we", "us"). By creating an account or using Gallerite you agree to these terms, together with our Privacy Policy, Cookie Policy and, where applicable, our Data Processing Addendum. If you do not agree, please do not use the service. We may update these terms from time to time and will post the updated version here.

2. Your account

You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and keep it up to date. You may not share or transfer your account, and you must access Gallerite only through the interfaces we provide.

3. Your content

You retain all rights to the photos and content you upload. You grant us the limited, worldwide, royalty-free licence needed to host, process and deliver that content to your Clients on your behalf. You are responsible for ensuring you have the rights and any consents needed for the content you upload — including consent, where a photograph features a child, of a parent or guardian.

4. Acceptable use

You agree not to misuse the service, including uploading unlawful, infringing or abusive content, attempting to disrupt or gain unauthorised access to the platform or other accounts, or infringing the rights of others. We may remove content or suspend accounts that breach these terms, and may cooperate with law enforcement where required.

5. Plans and payments

Paid plans are billed in advance on a recurring basis and renew automatically at the end of each period unless you cancel beforehand in your dashboard. Fees are in Naira unless stated otherwise and are non-refundable except where required by law. We may change pricing with reasonable notice. If we are unable to charge your card, we may suspend or downgrade your account.

6. Taking payments from your Clients, and chargebacks

When your Clients pay an invoice through Gallerite, payments are processed by Paystack and Gallerite is the merchant of record: funds run through our payment account and are then settled to you, less any applicable fees.

You are responsible for the transactions you take through Gallerite. If a Client raises a chargeback, dispute or refund on a payment made to you, you remain liable for the disputed amount and any related fees. You authorise Gallerite to recover these amounts by deducting them from your available balance or future payouts, and we may place a hold on, or suspend, payouts while a dispute is investigated or where we reasonably suspect fraud or unlawful activity. You are responsible for setting and honouring your own refund and cancellation terms with your Clients.

7. Payouts

Payouts are made to a Nigerian bank account in your name. To protect you, a payout requires a verified bank account (the account name must match your legal or business name), email confirmation of the account, and two-factor authentication. We may hold funds for a reasonable period to cover potential chargebacks or disputes.

8. Communicating with your Clients

Gallerite lets you email and message your Clients (including by broadcast and WhatsApp). You must have a lawful basis and any required consent to contact them, must offer a way to opt out of marketing messages, and must not message people who have unsubscribed or contacts obtained without consent. You must comply with applicable electronic communications and data protection laws. We may block or suspend these features if they are misused.

9. Taxes

You are responsible for determining, collecting and remitting any taxes (such as VAT) due on the services and products you sell to your Clients, and for your own business taxes. Any tax figures Gallerite calculates or displays are for your reference only and you should not rely on them to meet your tax obligations.

10. Intellectual property and infringement

The Gallerite platform, brand and software are our property. If you believe content on Gallerite infringes your rights, contact us at legal@gallerite.com with enough detail to identify the work and the material, and we may remove it.

11. Termination and data export

You may cancel at any time. We may suspend or terminate accounts that violate these terms or where we reasonably suspect fraudulent or unlawful activity. On termination you may export your data within a reasonable period, after which it may be deleted. We are not liable for loss of data after an account is cancelled or terminated.

12. Disclaimer and liability

Gallerite is provided "as is" and "as available". To the fullest extent permitted by law, we exclude implied warranties and are not liable for indirect, incidental or consequential damages, or for loss of data or profits, arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law.

13. Governing law and contact

These terms are governed by the laws of the Federal Republic of Nigeria. Questions about these terms? Email us at legal@gallerite.com.
